BPS Response to Enhanced Enforcement Announcement

Apr 17, 2021

On April 16, 2021, new restrictions were announced by the Government of Ontario, including a two-week extension of the current province-wide shutdown, in an effort to mitigate the rising case counts of COVID-19.

Enhanced enforcement measures were also announced for provincial offences officers, including police officers, under the Emergency Management and Civil Protection Act (EMCPA).

Once these new regulations are received, Brantford Police Service will conduct a thorough review and will notify the public on how we plan to implement the new provincial orders.

Brantford Police Service will not be conducting random vehicle or individual stops. We remain committed to providing the highest quality of policing service for the residents of Brantford and our pandemic enforcement initiatives will continue to be both complaint driven or proactive, with the goal of gaining compliance. Those that refuse to comply will receive the appropriate penalty.

We ask members of the public to respect the current stay-at-home measures and do your part to ensure the health and safety of our entire community. As soon as we have had an opportunity to conduct a full analysis of the new measures, we will communicate how this impacts our community.

This year has been particularly difficult for everyone. We know everyone is tired and overwhelmed with the changes but we need to continue to work together to protect the health and well-being of our entire community.

With our healthcare system at critical capacity, the Brantford Police Service continues to urge residents to take personal responsibility and follow the restrictions to limit the spread of COVID-19.

Taking part in large gatherings, including protests and demonstrations, contravenes the Emergency Orders. The Brantford Police Service recognizes the Charter protected right of any group to assemble peacefully in order to draw public attention to a specific cause so long as such a gathering does not breach any applicable statutes or municipal by-laws. Any gathering, regardless of its intended purpose, which is over the legal limit, will merit an appropriate police response in order to enhance community safety concerns.

Large gatherings of more than five people are not permitted under Emergency Orders.

Brantford Police Service is aware of a large gathering planned for the afternoon of Saturday, April 17, 2021 in the area of Henry Street and Wayne Gretzky Parkway. In the interest of public safety, we ask members of the public not to congregate in large gatherings and to avoid the area. Traffic delays or temporary street closures in the area may occur.

Any gatherings on private property without permission from the owner is considered an offence under the Trespass to Property Act.

As it is our duty to ensure the safety and well-being of the public, officers will de-escalate potential situations, but have the ability to enforce orders related to the shutdown as well as other provincial and federal laws, should this be necessary.

After a large gathering on April 3, 2021, officers identified organizers and to-date, a total of 27 breaches of the Provincial Reopening Act for Failing to Comply with a Continued 7.0.2 Order were issued following the event. The investigation is ongoing. Additional charges may result.

PUBLIC ADVISORY: OFF-ROAD VEHICLES PROHIBITED ON CITY ROADS AND TRAILS

Apr 12, 2021

The Brantford Police Service is reminding all off-road vehicle users to obey applicable laws and safety precautions when operating any off road vehicle and that off-road vehicle use on roads in the City of Brantford is prohibited.

In accordance with the Off-Road Vehicle Act, municipalities must have a by-law permitting certain All-Terrain Vehicle (ATV) and Off-Road Vehicle (ORV) use on roadways.

Currently, the City of Brantford does not have a by-law permitting on-road ATV/ORV use and as such, on-road driving of ATVs/ORVs in the City of Brantford is prohibited.

Additionally, motorized recreational vehicles of any kind - meaning dirt bikes, snowmobiles, go-carts, ATVS, or any vehicle propelled or driven by an internal combustion engine - are prohibited from travelling in any public park or City-maintained trail.

Utilizing these types of motorized vehicles on pedestrian trails creates significant safety risks to everyone who is utilizing the trail system.

BPS have responded to several complaints regarding trespassing, mischief and off-road vehicle use on the roadways and trails throughout the City of Brantford. Off-road vehicle riders have been reported to be on private property without permission and in some cases have caused damage to property and fields.

Being on private property, without permission from the property owner, is a violation under the Trespass to Property Act and could subject riders to charges. Causing damage by riding on property could subject riders to mischief charges.

Being a responsible rider by following laws and wearing approved helmets will significantly reduce the risk of injuries as well as being charged with offences.
