1. DELEGATION

a) Inspector Scott Easto - CALEA

Inspector Easto stated that the assessment team’s final report of the on-site assessment, conducted in December, had been received and we would receive re- accreditation at the July CALEA conference. He was pleased to report an improvement in our compliance rate from 91% at our last assessment to 93.4% during this assessment. As well, only two file maintenance issues were documented versus four during the last assessment.

Inspector Easto spoke of the benefits of the CALEA program, explaining that it is an ongoing quality assurance tool which looks at the entire Service. He noted that although the Ministry conducts audits of the Service, they normally select five areas for each audit and it may be years before those areas are inspected again. With CALEA all areas are inspected every three years, with proofs that the
Service is adhering to standards being required for each year.

THAT the Brantford Police Services Board re-affirms its support of the participation of the Brantford Police Service in the CALEA accreditation program.

3. REPORTS

a) Monthly Statistical Report

Deputy Chief J. Kellner highlighted points of interest in the April 2010 report.

b) Budget Report

The Monthly Operating Budget Report, for the period ending April 30, 2010, was received from Inspector Geoff Nelson, i/c Administration Branch. Chief McElveny noted the budget was on target.

c) Request for Return of Found Property

Chief McElveny recommended the return of a case of music CDs, found by a citizen and turned in to the Police Service, as the owner could not be located.

THAT the Brantford Police Services Board approves the request of Mr. Mike Boulard to return to him a case of music CDs, which he found and turned in to the Brantford Police Service, as the owner of the CDs has not been found.

d) Public Complaint #10-05 – Policy Complaint

Chief McElveny reviewed a report, prepared by Inspector Kent Pottruff, into a policy complaint regarding the Service’s response to a landlord tenant dispute. Investigation revealed that the training received by officers was based on the new Residential Tenancies Act; however, the Service policy had not been updated. The policy complaint was subsequently substantiated. Chief McElveny reported that the policy has since been updated. It was also determined that the response of the officers did conform to the new legislation; therefore, the conduct complaint was unsubstantiated.

e) Suspension Without Pay – Proposed Amendment to the Police Services Act

Chief McElveny reported that the OACP was approaching the Provincial Government to amend the Police Services Act to allow for the suspension of officers without pay in certain, very serious circumstances, and asked the Board to support this initiative.

THAT the Brantford Police Services Board supports and endorses the request of Chief D.V. McElveny with respect to supporting the initiative of the Ontario Association of Chiefs of Police (OACP) to amend the Police Services Act to allow for the suspension of officers without pay in certain, very serious circumstances

AND FURTHER that the Board forward correspondence with respect to the approved motion to the Minister of Community Safety and Correctional Services.

f) Proceeds of Crime – Seized Funds

Chief McElveny presented a report recommending that funds seized during investigations in 2006 and 2007 be transferred from the possession of the Police Service to the Board Auction Fund account as there is no court order for its disposition.

WHEREAS during police investigations in 2006, police seized a total $27,159.61
in cash where there is no court order for its disposition

AND WHEREAS during police investigations in 2007, police seized a total of
$9.218.81 in cash where this is no court order for its disposition

AND WHEREAS Section 133(3) of the Police Services Act allows a police services board to use it for any purpose that it considers in the public interest

NOW THEREFORE BE IT RESOLVED that the Board directs that the
$36,378.42 in cash be deposited in the Board’s Auction Fund Account

g) Police Service Vehicle Requirements

Chief McElveny reviewed a report by Inspector Geoff Nelson, which outlined the need to acquire three replacement vehicles and one additional vehicle for our officer seconded to the PAVIS program. In his report, Insp. Nelson recommended funding the purchase of these vehicles through the proceeds from the sale of four vehicles, using the existing reserve account funds, as well as accessing $45,000 from the Board auction fund account. Chief McElveny supported this recommendation.

WHEREAS the need for additional Police Service vehicles exist to meet the Brantford Police Services Board’s obligation with respect to PAVIS (Provincial Anti-Violence Initiative Strategy)

AND WHEREAS the need to replace a number of older Police Service vehicles exist

NOW THEREFORE BE IT RESOLVED that the Brantford Police Services
Board approves the sale of surplus/decommissioned Police Service vehicles

AND FURTHER, the Board approves the transfer of $45,000 from the Police Services Board Special Projects Account (150500) to Reserve Account 138 (Police Vehicle Replacements)

AND FURTHER, the Board approves the transfer of $70,000 from Reserve Account 138 (Police Vehicle Replacements) to Minor Capital Account PD 10-01 in order to purchase the required vehicles.

5. NEW BUSINESS

a) Semi-Annual Presentation to City Council

The Board normally makes a semi-annual presentation to City Council on the Brantford Police Service to City Council. Suggested dates were June 21 and August 9. It was decided that this year the Board will provide a written report.

6. NEXT MEETING DATE

The next public meeting of the Board will be held on June 22, 2010, at 1:00 p.m. The meeting adjourned at 1:30 p.m.
The minutes of this meeting were adopted this 22nd day of June, 2010.
