Freedom of Information

The Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), is legislation that covers Ontario's municipalities and local boards, including police services. Under this legislation, individuals can request access to any record held by government organizations, including the Brantford Police Service.
The purpose of the Act is:
  1. to provide a right of access to information under the control of the government organization
  2. to protect personal information held by government organizations and to provide individuals with a right of access to their own information.

Records will only be released to the following:

  • The person or company directly involved
  • The law firm whose client is directly involved (with consent of the client)
  • The insurance company whose information is directly involved (with consent of the insured)

Requests must be made in writing by completing the Access/Correction Request Form accompanied by the $5.00 legislated application fee in person or by mail to:

If you are mailing your request, you must also include a photocopy of two pieces of government issued identification (one must contain a photo).

Institutions must charge a mandatory $5.00 application fee for each freedom of information request. 

Additional fees may be charged for services, such as photocopying and shipping, in accordance with the fees prescribed by regulation. 

  • A request for personal information may be subject to $0.20 per page photocopying charges, above the initial application fee.
  • A request for general information may be subject to a search time charge of $30.00 per hour, a preparation time charge of $30.00 per hour and $0.20 per page photocopying charges. Brantford Police Service has set fees for Officer Notes, video and audio recordings and photographs.

Applicants will be advised of any additional fees that may apply.

Brantford Police Service accepts certified cheques and money orders payable to the Brantford Police Service.

If submitting your request in person, you may pay by cash, debit, Visa or Mastercard.

Under MFIPPA, we are required to respond to your request within 30 days. We may extend this time period if required, but the requestor will be provided with written notice.

Please note that your request will be delayed if you do not provide exactly what you requesting, fail to pay the required application fee or complete the authorization/consent form.

There is no way to expedite a request. You can indicate the date the report is required when the request is submitted, however we cannot guarantee that the records will be ready in advance of the legislated timeframe.

This is dependent on what is being requested. Personal information of other individuals will be redacted (blacked out) unless consent from those individuals is obtained. Requests are processed in accordance with the Municipal Freedom of Information and Protection of Privacy Act and any exemptions that may apply to your request.

Please note that you will not receive any information pertaining to a report if:

  • You are not directly involved in the occurrence.
  • Records relate to an ongoing law enforcement investigation.
  • Records relate to a matter that is currently before the courts, or the 30-day appeal period has not been completed. This includes outstanding arrest warrants.

 

Police Records relating to "Young Persons" are governed by the Youth Criminal Justice Act (YCJA). Release of records in what a young person has been dealt with under the YCJA is prohibited via the FOI process.

As a landlord, you have access to information about the property, e.g. property damage. If you are seeking copies of reports pertaining to your tenants, consent is required by all involved parties.

Proof of ownership of the property will be required at the time you submit your FOI application.

Individuals can correct personal information or attach a statement of disagreement to a record held by the Brantford Police Service. If you would like the spelling of your name or date of birth corrected, you must provide valid government identification as proof.

You may disagree with an officer's opinion or statement within an occurrence report. This information will not be corrected or deleted. However, you may attach a statement of disagreement to the police occurrence report or officer's notebook entry.
